Claims Manager –Cuxtal II Project

Ubicación: CDMX o Mérida

 

 

Purpose of the Position:

Identify, develop, evaluate, prepare, negotiate, and ensure the timely and correct execution of Claims management strategy for the Project main Contracts: Engineering, Procurement, Construction (EPC), Construction Supervision, Owners Engineer, Supply of Pipe and Turbo-compression equipment for gas transportation assets and services, among others, aligned to the Clients contractual framework and contract(s) specifications to. With an specific focus on risk mitigation.

 

 

Responsabilities and Job Functions:

1

Monitor the day-to-day Contracts communication to identify and follow-up on potential claims related to the execution of Contractual Obligations.

Ensure Formal Communications with Contractors/Suppliers related to Claims are delivered on time, according to the contract notifications procedure and aligned with legal.

Lead Claim Management, in full coordination with the Project Team and Legal team, to:

  • Identify and maintain an updated facts and events traceability matrix,
  • Prepare claims as they arise, requesting additional LDs, cost, or time compensation to contractors/Suppliers.
  • Review and challenge any claims from contractors.
  • Develop the negotiation strategy, documentation and support negotiations of claims.
  • Prepare, update, and finalize any required event claims (e.g., Force Majeure) / change orders / amendments to the offtaker(s), Fully document any material events which may result in formal dispute, as required by the legal team, to ensure Engie’s position.
  • Verify contractors fully comply with Engie’s standards on ethics and anti-corruption.

Regarding contractor/supplier relationships

  • Provision of contractual advice to Project Team (e.g., flow down from TSA) for major subcontracts and suppliers in relation to claims.
  • Ensure all guarantees, insurance policies, bonds, etc are delivered by the Contractor and remain current throughout the project lifecycle.
  • Communicate and raise timely warnings to prevent disputes and claims
  • Support the purchasing team when necessary for subcontracts and supply contracts negotiation.
  • Ensure and follow-up all claims until contract close-out.

 

 

Ocupational Profile:

University degree in Law or Engineering with formal education in law.

plus extensive experience in the construction industry within midstream O&G sector. (Mandatory)

✓  Knowledge of regulatory requirements for the construction and operation of gas transportation projects in Mexico.

✓  Knowledge of Mexican legislation applicable to contract law (EPCM, O&M and Professional Service agreements).

✓  Knowledge of Construction phases withing pipeline projects, cost estimating.

✓  Knowledge on instruments required to guarantee delivery, quality, and performance (bonds, insurance policies, Letters of Credit, etc.).

✓  Ability to evaluate the legitimacy of a claim as well as understand and interpret the main contract provisions by challenging costs, and how these affect scope and schedule.

✓  Ability to interface with contractors and offtaker(s) on issues ranging from administration of the contract to all matters relating to the review and process of claims, changes, and amendments.

✓  Knowledge and capacity to draft and prepare court documents related to arbitration or disputes.

✓  Knowledge of disputes legal procedures, in Mexican and international courts, rules of international arbitration and procedures.

 

15 years of relevant experience in claims management of major contractors in roles dealing with negotiation and management of gas transportation (pipeline) projects, change procedures, cost management, claims and variations, negotiation and settlement of disputes and international arbitrations with contractors and offtaker(s).

 

Ability to write, speak and carry out contractual negotiations in Spanish and English is a must.

Sr Acquisition Investment & Financial Advisory (AIFA Sr)

 

Purpose of the Position:

 

Lead and be responsible for analyzing investment proposals for internal approvals, the structuring, negotiation and closing of M&A and project finance transaction, and for the management and coaching of junior members of the team As part of its mission, the Senior Financial Advisor will have responsibility for the valuation and risk analysis of new projects (including review of financial models) and for the preparation of financing plans, selection of funding sources / banks (in coordination with team leadership), structuring and execution of project financings and M&A transactions.

 

 

Responsabilities and Job Functions:

 

• Manage junior financial advisors and provide coaching to part of the team in Project Financing and financing documentation, M&A, and investment valuation and structuring.

• Monitor and assess liquidity and provide constructive advice on terms and general trends of regional and international project finance debt markets and Debt Capital Markets.

• Assist team leadership in the management of relationship with leading international commercial banks, regional and local commercial banks, relevant export credit and multilateral agencies and other funding institutions.

• Monitor and assess competitors’ approaches to financing / funding projects and potential mobilization of new financing sources.

• Be responsible for the risk assessment, valuation, financing plan structuring, negotiation and closing activities for greenfield, brownfield and M&A transactions in coordination with Business Development team.

• Advise on risk allocation, bankability issues, optimization & tax structuring.

• Responsible for reviewing and approving financing, accounting and tax related inputs in financial models (where required with the support of relevant expertise centres and/or external consultants)

• Contributes to the setting of internal procedures for the AIFA Latam team and responsible for adherence with Global AIFA procedures.

 

 

Ocupational Profile:

 

• Finance / Economics based degree or a professional qualification such as CFA, CIMA, ACA, ACCA (or equivalent)

• Minimum 6 years of relevant experience in Project Financing and Financial Advisory.

• Demonstrated experience in leading, negotiating and closing large-scale international / regional project finance transactions in the energy sector.

• Experience in the Latam region.

• Experience in planning and managing complex financial closing processes.

Post-operations Sr Engineer

Propósito del puesto:

El objetivo del ingeniero de post-operación es asegurar la fiabilidad y exactitud de los indicadores de desempeño de las centrales de generación de energías renovables de ENGIE México. Su labor se centra en proporcionar análisis confiables para la toma de decisiones y para generar valor al negocio.

           

Funciones y Responsabilidades:

  1. Aplicar las metodologías de cálculo de indicadores de desempeño de manera exacta y fiable para generar información 100% confiable para la alta dirección y otros equipos de manera oportuna. Incluyendo el cálculo del impacto de eventos extraordinarios cuando se requiera.
  2. Preparar y cargar KPIs a las bases de datos oficiales del grupo. Analizar tendencias y la evolución en el tiempo para identificar posibles discrepancias y áreas de mejora. Así como participar en el desarrollo de las herramientas para lograrlo. Incluye reportar a Perform, carga y categorización de datos a Darwin, análisis comparativos entre los resultados de Darwin y los del VOB Vestas para Wind y los cálculos propios de la R-GBU para Solar.
  3. Realizar los reportes oficiales de la dirección de Asset Management, de manera general y por activo, manteniendo estrecha comunicación con las gerencias del área para cumplir con los compromisos de manera oportuna.
  4. Comunicar los resultados y los hallazgos de manera clara y precisa, usando las herramientas de business information del grupo y de la R-GBU, para facilitar decisiones estratégicas y la optimización continua.
  5. Utilizar la metodología establecida en la regulación y las herramientas de Energy Margin para calcular el impacto económico de las afectaciones del performance, eventos extraordinarios y otros factores que afecten los estados financieros.
  6. Cumplir y hacer cumplir las normas, reglas y procedimientos internos y externos en materia de Seguridad Industrial, Seguridad Operativa, Protección del Ambiente y Aspectos Sociales relacionados con las actividades bajo su mando, asumiendo la responsabilidad con base en su jerarquía y área de influencia en:
  • El cumplimiento de los elementos del Sistema de Gestión Integrado
  • La evaluación de los riesgos relacionados con la seguridad y la salud de los colaboradores bajo su mando (incluyendo al personal de contratistas, subcontratistas, proveedores y prestadores de servicios
  • La administración de la seguridad operativa en los procesos dentro de su área de influencia
  • La identificación, evaluación y control de los aspectos e impactos ambientales

  • Participación y rendición de cuentas en ejercicios de auditoría internas o externas

 

Perfil Ocupacional y experiencia:

 

Escolaridad: Ingeniería o ciencias Ambientales, Energía Renovables, Sistemas de Energía o carrera afín.

Experiencia: 1 año de experiencia en funciones de monitorización, retroalimentación de eficiencia o cálculo de indicadores de desempeño relacionados con energía

Competencias técnicas: Es deseable tener conocimientos de la regulación que rige los  mecanismos con los que opera el Mercado Eléctrico Mayorista (MEM) en México y estándares del sector. Nociones de la Ley de la Industria Eléctrica (DOF 2014 LIE), Bases del MEM (DOF 2015 Bases del MEM). La formación en estándares de monitoreo del desempeño de plantas de energía renovable es un plus, ejemplos son IEC 61724-1, IEC 61724-2, ASTM E2848, IEC 61400-25-1, IEC 61400-12-1.

Purpose of the Position:

Design quantitative models to support risk management strategy, pricing and product design, through improved understanding of daily market conditions and it’s impact on mid and long term pricing curve, and correlations across Mexico’s interconnected system

  • Advanced mathematical model development:

Propose and develop models that represent power market conditions with high precision.

Propósito del puesto:

Proporcionar servicios y datos de contabilidad financiera de manera oportuna y precisa. Asegurarse que todas las actividades asignadas se realicen en tiempo y forma en función a los estándares requeridos por la empresa. La ejecución y revisión de todos los registros contables se realizará de acuerdo con las normas internacionales de contabilidad (NIIF) o cualquier otra política o normativa interna de la empresa.

 

Funciones y Responsabilidades

  1. Asegurar que todas las actividades del proceso de cierre contable se ejecuten en tiempo y en las fechas establecidas.
  2. Entregar buenos resultados en KPIs. Buena calidad en reconciliaciones de cuenta balance sin rechazos, mantener las partidas mínimas abiertas en la limpieza de las transacciones de bancos, responder en tiempo cualquier requerimiento o solicitud de nuestras contrapartes en NORAM tales como pólizas contables, reportes, análisis así como solicitud de apoyo.
  3. Revisar y asegurarse de que todos los movimientos bancarios hayan sido correctamente reconocidos y contabilizados en SAP (Transacción FEBAN) así como mantener limpias las cuentas transitorias de bancos dando seguimiento a todas las partidas abiertas pendientes de liquidar.
  4. Apoyar en cualquier solicitud o requerimiento de auditoria sea interna o externa.
  5. Preparar conciliaciones de balance asegurándose que todas las cuentas contables tengan una conciliación en sistema Cadency así como incluir todos los soportes adecuados y necesarios para que la conciliación sea certificada y aprobada por los contadores de NORAM.
  6. Apoyar con nuevos proyectos y brindar el soporte necesario a las áreas de negocio y administrativas.
  7. Tener comunicación periódica y efectiva con su superior inmediato (N+1) siempre informando de los temas relevantes o de riesgo dentro de sus actividades o del área.
  8. Interactuar y tener buena comunicación con todo el equipo creando un buen ambiente de trabajo, relación laboral sana y asistirlos cuando lo necesiten (entre torres y otros equipos).
  9. Salvaguardar la información contable en el repositorio que se le asigne, asegurando que información respectiva este resguardada.

 

Ocupacional y experiencia:

Lic. Contabilidad

2-4 años de experiencia en cargos similares. Mínimo 3 años de experiencia en entidades de tamaño grande/internacional, como contador.

• 2 Power Generation Plants with 280 MW based on natural gas 

• 1 GW of 100% clean energy generated by 2 wind and 6 solar plants. 

 

Purpose of the Position: 

The Finance Director will direct and oversee the financial activities of the all the Transportation Companies, responding directly to the ENGIE MEXICO CFO at Engie structure and across the board to the Natural Gas Transport CEO for each Transportation Company based on the relationship established at each Transportation Company in the is yours Service Level Agreements (SLA).

The Finance Director will be responsible of the adequate financial control and strategies of those companies by providing leadership, direction and management of the finance teams (financial planning, controlling, treasury, taxes and accounting).

The Finance Director will lead the preparation of the financial reports and all other financial requirements maintaining the financial compliance of the company at Legal, Financial and Regulatory levels.

The Finance Director is responsible of the Board of Directors reporting and financial planning, maintaining the Top Management well informed and providing the adequate information on time for the decision making.

 

Responsabilities and Job Functions: 

 

- Responsible of the annual budget process, ensuring accurate and timely reporting for all the required versions (short, mid and long term), being able to explain the variations on a detailed and executive basis to ease the decision making and maintain well-informed to the top management and decision makers.

Propose restructures, resizing or cost efficiencies to improve the company financial performance with no risk and/or business impact. Identify and anticipate potential risks that could affect the financial results of the companies.

Ensure the proper control of the projects of the companies and their budgets, ensuring the compliance at financial, fiscal, legal and regulatory level.

- Coordinate and supervise the preparation of the financial statements (internal and external/audited) and coordinate the annual audit process to deliver the audited financials on timely manner to comply with the deadlines committed with the main stakeholders (Corporate Team, Lenders, Partners, Regulator, etc.)

Also is responsible to ensure the timely delivery of all the regulatory (tariff reviews, regulator audits and any other requirement) and tax reporting (tax declarations, tax opinions to avoid fines or penalties, maintaining the duly compliance of the company.

Liase with the external partners of the applicable Transportation Companies, being the main SPOC for them to ensure to cover their financial requirements and/or their information needs.

Prepare and present the periodical financial reporting to the Board of Directors and any other committee which requires financial inputs or information.

 

Ocupational Profile: 

  • BS in Public Accounting, business administration or finance required / Master’s Degree and/or CPA preferred.
  • Accounting in accordance with Mexican GAAPs and IFRS.
  • Taxes Reporting under IFRS and local GAAPs.
  • Strong Knowledge of Bank system and financing schemes, corporate and project finance, Insurance, Business Control, Enterprise Risk Management.
  • 5-10 years of experience as Sr Manager or Director in multinational companies.
  • Bilingual English/Spanish – Must
