ENGIE Whistleblowing System

As part of the Group's constant drive to deepen its commitment to ethics and to provide easy-to-use tools for anyone to report inappropriate situations or those that are not in line with our principles or current laws and regulations, ENGIE has put in place a whistleblowing System that is open to all employees and stakeholders (suppliers, sub-contractors, unions, NGOs, etc.).

This System supplements existing channels and strengthens the Group's Ethics and Compliance efforts. It is open to anyone and is easy to use, confidential, and anonymous if need be.

 

Who can use it?

The alert system is intended for all Group employees and all the stakeholders who are victims or witnesses of an incident.

  • All Group Employees (whether they have a permanent or temporary contract), no matter their role, activity sector, or country.
  • Any of the Group’s stakeholders, on all of our worksites, wherever we are: service providers, suppliers, subcontractors, populations living close to the Group’s worksites, NGOs, non-financial rating agencies, etc.

 

How does it work?

 

WHISTLEBLOWER
  • The whistleblower reports an incident, anonymously or not, by telephone or e-mail, to the external service provider.
  • By telephone: Calls can be made in the following languages: French, English, Spanish, and Portuguese, and will be dealt with by the service provider who will record any information that is reported (for an alert made in another language, it is recommended that the whistleblowing be sent via e-mail and the message will then be subject to a translation).
    The whistleblower receives a case number for tracking how the alert is handled. It is submitted anonymously to ENGIE, so that the incident can be handled.
  • By e-mail: Alerts should ideally be submitted in French, English, Spanish, or Portuguese. Any written alert made in another language may be translated.

 

How is a whistleblowing made?

 

  • Alerts can be made at any time, 24 hours a day, in 4 languages (French, English, Spanish, or Portuguese).
  • Single e-mail address for the entire Group: ethics@engie.com
  • The whistleblower can alert inFrench, English, Spanish, or Portuguese. Messages written in other languages will be translated.

This service is available in four languages (French, English, Spanish, Portuguese) during business hours.

The external service provider that runs the whistleblowing system receives the alerts. This service provider is a recognised expert in the field, guaranteeing that the Whistleblower Policy is properly followed (including confidentiality).

 

Your personal data is protected

 

The personal data collected via the ADIT system are processed under a service contract between ENGIE SA and its Provider responsible for collecting and managing the follow-up of professional alerts. 

 

The data processing implemented by ENGIE SA, 1 place Samuel de Champlain 92 930 PARIS LA DEFENSE cedex 17, is carried out within the framework of the legal obligation resulting from the Sapin 2 Law of December 10th of 2016, allowing any person who so wishes (employee or stakeholder external to the Group) and who has an interest therein, to inform the Group in a disinterested manner of any serious fact concerning him/her directly or indirectly of which he/she would have personal knowledge, on various fields.

 

The data collected are kept for 5 years after pseudonymization and from the closure of the procedure concerning the alert. They are reserved for the use of the departments concerned and may only be communicated (for some of these data) to the following recipients: The ENGIE Group's Director of Ethics, Compliance and Privacy, persons who need access to the information for the purposes of investigating the alert, or the judicial authorities, if applicable.

 

Data may be transferred outside the European Union, if the ENGIE entity concerned or the persons having access to the information are outside the European Union. The following guarantees have been taken to ensure a sufficient level of protection of personal data: Signature of Binding Corporate Rules (BCR) or binding company rules within ENGIE.

 

In accordance with the applicable regulations, you may request access, rectification or deletion of your data. You can exercise these rights by contacting : Contact. Proof of identity may be required.

1. What is a whistleblowing System?
 

A whistleblowing System or “professional whistleblowing” is a mechanism placed at the disposal of the Group’s employees and stakeholders for reporting actions or behaviours that may compromise individuals’ integrity and/or rights, that may affect Group activity, for create serious liability (health and safety, environment, human rights, individual rights, privacy. etc.).

 

2. Who is it for?
 

The whistleblowing System is open to all Group employees and external stakeholders who have personal knowledge of an incident and who are acting without any personal interest and in good faith. Whistleblowers may be:

  • Any Group Employees (whether they have a permanent or temporary contract), no matter their role, activity sector, or country
  • Any of the Group’s external stakeholders, on all of our worksites, wherever we are service providers, suppliers, subcontractors, agents, populations living close to the Group’s worksites, NGOs, non-financial rating agencies, etc.

 

3. What kinds of actions or behaviours can be reported?
 

Any breach of our ethics principles, as well as all other violations of laws and regulations and any incident relating in particular, but not exclusively to the following areas :

  • Human rights
  • Fraud
  • Corruption
  • Data privacy
  • Harassment
  • International sanctions and embargoes
  • Health & Security
  • Environment
  • Discrimination
  • Any crimes or offences
     

What to remember

  • Alerts must be made in good faith, free of any malice.
  • Alerts may be made for any serious incident that the whistleblower has personal knowledge of.

 

4. Is it confidential and anonymous?

We respect the confidentiality :

  • of the whistleblower's identity,
  • of the identity of anyone identified by the alert,
  • of any documents that may be sent and received as part of the alert.
     

Useful information :

If an alert is made anonymously, ENGIE is committed to protecting the whistleblower's anonymity. In this case, it is the whistleblower's responsibility to contact the Service Provider to follow-up on their alert.

 

5. What protection for the whistleblower?
 

No retaliatory measures (legal or disciplinary), linked to the alert, will be taken against them by ENGIE. If the whistleblower believes that he is the victim of a retaliatory measure, he should immediately report it through the whistleblowing System.

However, any abusive or inappropriate use of the whistleblowing system may give rise to further action.

 

6. Who is responsible for dealing with the alerts?
 

An external service provider receives all the alerts, guaranteeing the confidentiality of any information they contain and fulfilling all legal obligations.

Anonymous information is addressed to the Group Ethics, Compliance & Privacy Department for it to be examined and investigated.
